Please read these General Terms and Conditions (“Terms,” “Terms and Conditions”) carefully before using the TCM Handmade Custom Leather Shoes website (the “Service”) operated by TCM (“us,” “we,” or “our”).
When you purchase a product from TCM, the following General Terms and Conditions of Business come into force between you, the Customer and The Canis Majoris (TCM), the seller.

2.1 TCM Handmade Custom Leather Shoes is a brand that specializes in designing and crafting custom leather shoes.
2.2 Our Service allows you to browse and purchase custom leather shoes through our website.
3.1 To place an order, you must provide accurate and complete information regarding your customization preferences, measurements, and any other details required.
3.2 Without prejudice to the above, TCM explicitly reserves the right to limit, decline or reject any sales and orders for any reason, without being liable for any damage or costs other than repayment of any amount received from you in relation to such sale or order, in situations including but not limited to:
(i) an event outside TCM’s control (as will be defined below);
(ii) the product sought to be purchased is not available or in stock ;
(iii) when there are insufficient guarantees of solvency;
(iv) your order is flagged up by our security systems as unusual order or an order susceptible to fraud;
(v) your billing information is not correct or not verifiable;
(vi) your bank transfer payment is not received within 2 days after acceptance of your order.
3.3 Once an order is placed, changes or cancellations may not be possible. Please review your order carefully before submitting it.

3.4 We shall not accept procurement risks, nor shall we enter into a sales contract concerning unascertained goods. We are obliged to deliver solely from our stock of goods on hand.
3.5 If the contract cannot be executed or if TCM cannot fulfill your order, we will promptly notify you by email, stating the reasons for non-execution. If the products on our website are unavailable at the time of your access or after we receive your order, we will inform you of their unavailability within 3 working days.
4.1 Local orders: the prices displayed on our website are in the currency specified and are inclusive of applicable sales taxes. There are minimal shipping charges for local orders. The currency specified on our website is to be converted to the customer’s specified currency and is exclusive of sales taxes, shipping and handling. Please refer to our shipping and delivery policy for a clear understanding.
4.2 We reserve the right to update our prices at any time without prior notice. However, the price charged for an order will be the price in effect at the time of purchase.
4.3 50% advance payment must be made at the time of placing an order.
4.4 We prioritize order security by using a highly secure encryption platform on www.thecanismajoris.com. Your payment information is protected from the moment you enter it until the transaction is processed, and we do not store it on a public server. However, please be aware that despite our encryption measures, the internet and email transmission carry inherent security risks. TCM cannot be held liable for any damages resulting from electronic communication, including delivery failures, delays, interception or manipulation by third parties, or transmission of viruses.
4.5 We accept payment through the methods specified on our website. Any alternative payment methods used are at your own risk, and TCM will not be responsible for any loss of payment or resulting damages.
4.6 Customer account credit. You are not entitled to cash redemption for any credit on your customer account and credit on your account can not be transferred to third parties.
4.7 An unauthorized denial of acceptance, outside the scope of our return and exchange policy, of the merchandise shipped by us constitutes breach of contract, entitling TCM to charge the occurring costs / damages amounting to at least 70% of the sale amount.
4.8 If the delivery period is affected by circumstances beyond our control (force majeure), the delivery period will be extended accordingly. If the hindrance in providing the service lasts for more than 4 weeks, the customer has the right to cancel the contract. In such cases, no further claims, including claims for damages, will be applicable.
6.1 We ship our products to the addresses provided by customers during the ordering process. It is your responsibility to ensure the accuracy of the shipping address.
6.2 Delivery times may vary based on the destination and requested customization. We strive to deliver your order within the estimated delivery time, and if there are any changes, we will promptly communicate them to you.
Our shoes are made to order and require approximately 10 – 12 calendar days to handcraft. Normal shipping times vary between 4 to 7 business days for inland delivery.
6.3 Once your transaction is complete, TCM will confirm your order with you through “Confirmation of Order” e-mail or text. Once the confirmation is done, we then package and handover your shipment to the Courier service depending on your payment method.
6.4 There are minimal shipping charges for local orders. For international orders; shipping and delivery are to be borne by the customer.
6.5 We deliver products from Monday through Friday. We do not ship on certain public Holidays. We can only fulfill an order to a delivery address which is a home or office address.
6.6 TCM will not be liable or responsible for any failure to perform, or delay in performance of, any of obligations that is caused by events outside our reasonable control or Force Majeure. Force majeure includes, without limitation, strikes, lock-outs, administrative intervention, scarcity of energy and raw materials, transport bottlenecks and operational hindrances, and any act or an extraordinary and unforeseeable event beyond TCM’s reasonable control.
6.7 Where possible, we try to deliver in one go. However, we reserve the right to split the delivery of your order, for instance (but not limited to) if part of your order is delayed or unavailable. In the event that we split your order, we will notify you of our intention to do so by sending you an e-mail to the e-mail address provided by you at purchase.
6.8 Upon delivery, if it appears that the products are damaged, please do not accept the shipment and send us a picture as a reason for refusal. Please also note that you should inspect the products within 24 hours after they have been received. You will be deemed to have accepted the products unless you have notified us within 24 hours that the products are rejected.
6.9 TCM products purchased from any other site or source will not be our liability.
At TCM, we want you to be completely satisfied with your purchase. Therefore, we offer a straightforward refund and exchange policy to ensure your peace of mind. Please read our Refund and Exchange Policy carefully before making a purchase.
If you receive an incorrect item, please contact us within seven (7) calendar days (hereinafter referred to as “stipulated time”), after receiving the product.
Your item is applicable for an exchange if it falls within the following reasons:
In the case of receiving an incorrect size, the fault being ours, you are eligible to exchange your product with the correct sized pair within the stipulated time.
You are entitled to exchange products delivered to you in the event of declining a damaged product/shipment (picture evidence required.)
You can do so within the respective stipulated.
Disclaimer: Upon delivery, if it appears that the products are damaged, please do not accept the shipment and send us a picture as a reason for refusal. You will be deemed to have accepted the products unless you have declined the shipment.
You are entitled to exchange products delivered to you in the event that you have received an incorrect item as an error from our end, within the stipulated time.
Your item is applicable for a refund if it falls within the following reasons:
(i) Should there be an unavoidable delay in the delivery timeframe due to circumstances beyond our control, such as force majeure, the estimated delivery period will be proportionately extended. However, if the provision of service is impeded for more than four weeks due to such circumstances, the customer reserves the right to cancel the order. Please note that in such instances, any additional claims, especially those pertaining to damages, will not be acknowledged.
(ii) the product sought to be purchased is not available or in stock ;
(iii) when there are insufficient guarantees of solvency;
(iv) your order is flagged up by our security systems as unusual order or an order susceptible to fraud;
Please be aware that reimbursements will be processed using the same payment method that was employed at the time of purchase.

9.1 Product Warranty: TCM strives to ensure the highest quality in its handmade custom leather shoes.
However, due to the nature of handmade products, slight variations in color, texture and fit may occur.
9.2 Wear and Tear: TCM cannot be held liable for any damage, wear or tear that occurs to its products as a result of normal use or misuse. This includes but is not limited to scratches, scuffs, color fading, stretching or damage caused by improper care, neglect or accidents.
9.3. Allergies and Sensitivities: TCM uses high-quality materials, including leather and various dyes and finishes. However, TCM cannot guarantee that its products are suitable for individuals with specific allergies or sensitivities. It is the responsibility of the customer to ensure that they are not allergic or sensitive to any materials used in TCM products before making a purchase.
9.4. Indirect and Consequential Damages: In no event shall TCM be liable for any indirect, incidental or consequential damages arising out of the use or inability to use its products, including but not limited to, loss of profits, loss of data or any other financial or personal loss.
9.5. Limited Remedy: In the event that a TCM product is found to be defective or non-conforming, the customer’s sole and exclusive remedy shall be limited to the replacement or refund of the purchase price of the product at TCM’s discretion.
9.6. Third-Party Products: TCM may, at its discretion, include or recommend third-party products or services on its website or through other channels. TCM does not assume any responsibility or liability for the quality, performance or safety of these third-party products or services.
9.7. Force Majeure: TCM shall not be held liable for any failure or delay in performance of its obligations under these terms and conditions if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labor disputes or governmental actions.
We reserve the right to unilaterally amend these General Terms and Conditions of Business if necessary to address any subsequent disruptions to the contractual relationship with the customer or to adapt to changes in the legal or technical environment. The amendment will become part of the contract.
